New Residency Qualifications for Accepting Talents
In December 2018, the Provisional National Assembly passed the Partial Amendment Law of the Immigration Management and Refugee Identification Law and the Establishment Law of the Ministry of Justice, with the main content of "specific skills" for newly established stay qualifications. Starting from April 1, 2019, 12 industries that will face severe staffing shortages will be able to accept foreigners holding "specific skills" to stay.
The implementation of the "specific skills" system for retaining qualifications is to address the increasingly serious shortage of personnel among small and medium-sized enterprises. There are measures to improve production efficiency and ensure domestic talent in China. In areas where it is difficult to ensure talent and difficult situations, we recruit foreign talents with certain professionalism and skills.
Specific industry sectors (12 domains)
Nursing, building cleaning, mold industry, industrial machinery industry, electrical and electronic information industry, construction, shipbuilding and shipbuilding industry, automotive repair and maintenance, aviation, accommodation services, agriculture, fisheries, food and beverage processing, and catering services.
Specific skill number 1 pre employment process
Key Point 1 of Specific Skills
▶ Duration of stay: Within a period of no more than 1 year, updated by the Minister of Justice for specific foreigners (total time not exceeding 5 years)
▶ Skill level: Assessed through exams and other assessments (foreigners who have completed skill internship number 2 do not need to take the exam)
▶ Japan and proficiency level: Assess whether one has the necessary Japanese language skills for daily life and work through exams (foreigners who have completed skill internship number 2 do not need to take the exam)
▶ Family Accompanying: In principle, it is not allowed
▶ Support objects of receiving institutions or registered support institutions
Key Point 2 for Specific Skills
▶ Stay period: updated every 3 years, 1 year, or 6 months
▶ Skill level: evaluated through exams and other assessments
▶ Japanese language proficiency level: no need to pass exams or other assessments
▶ Family Accompanying: Qualified (spouse, children)
▶ Support objects for non receiving structures or registered support organizations
